Do you have to file a US tax return if your clients are American? It depends on how you earn, and getting it wrong can be costly.
Many Pakistani freelancers, consultants and online sellers now work for US clients or run a US company. US tax rules treat these cases very differently, and the paperwork is easy to miss.
Freelancing for a US client from Pakistan. If you are not a US citizen or resident and you do the work from Pakistan, your income is generally treated as foreign-source, and most people in this position do not file a US return. The client will usually ask you to complete Form W-8BEN. It confirms you are a foreign person so the client does not withhold US tax. You still report this income in Pakistan, so keep your invoices and bank records in order.
Owning a US LLC or company. Here the rules are stricter. A US company owned by a foreign person generally has to file Form 5472 with the IRS, and a single-member LLC files it with a pro forma Form 1120. The IRS instructions set a $25,000 penalty for failing to file when due, even when the company owes no tax. Many owners only learn this after a penalty notice arrives.
Living or working in the US. If you are a US citizen, a green card holder, or you meet the substantial presence test, you file a US return on your worldwide income, and the Pakistan side needs to be reported consistently.
